1. Agreement to Terms

By accessing or using the services of Blue Messaggio (“we”, “us”, “our”), including our website, APIs, SMS, WhatsApp Business API, RCS, and related messaging services, you agree to be bound by these Terms & Conditions. If you do not agree, do not use our services.

2. Description of Services

Blue Messaggio provides enterprise messaging solutions, including but not limited to: bulk SMS, WhatsApp Business API, RCS messaging, voice, and related APIs and tools. Services are subject to availability and may vary by region.

3. Account and Use

You must provide accurate information when registering and using our services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to use our services only for lawful purposes and in compliance with applicable laws, including telecommunications and data protection regulations.

4. Acceptable Use

You may not use our services to send spam, unsolicited messages, or content that is illegal, harmful, or infringing. You must comply with carrier and platform policies (e.g. WhatsApp, Google) and obtain necessary consents where required. We may suspend or terminate access for misuse.

5. Fees and Payment

Fees for services will be as agreed or as set out in your plan. You are responsible for paying all applicable charges. We may change pricing with reasonable notice. Failure to pay may result in suspension or termination of services.

6. Intellectual Property

All intellectual property in our platform, website, and materials remains ours or our licensors’. You may not copy, modify, or reverse-engineer our services except as permitted by law or with our written consent.

7. Privacy

We process personal data in accordance with applicable data protection laws. By using our services you agree to our handling of data as described in our communications and as required by law.

8. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability shall not exceed the fees paid by you in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless Blue Messaggio, its affiliates, and their officers and employees from any claims, damages, or expenses arising from your use of our services or breach of these terms.

We may update these Terms & Conditions from time to time. Continued use of our services after changes constitutes acceptance. We will post the updated terms on this page and update the “Last updated” date.
